These Beta Terms of Use ("Terms") apply to your use of the onTrak CueSports mobile application and related services during its beta testing period.
onTrak CueSports is operated by ONTRAK SPORTS LTD ("onTrak", "we", "us" or "our"), a company registered in the United Kingdom.
By creating an account or using onTrak, you agree to these Terms and acknowledge our Privacy Policy.
If you do not agree to these Terms, you should not use onTrak.
1. Beta service
onTrak is currently being provided as beta software.
This means that features are still being tested and developed. During the beta:
features may contain bugs or errors;
results may occasionally be inaccurate;
features may change, be added or removed;
the service may occasionally be unavailable;
data may occasionally need to be reset or corrected; and
performance may vary between devices, tables, lighting conditions and network connections.
Your feedback and problem reports may be used to help us improve onTrak.
We do not guarantee that every beta feature will appear in the final commercial version.
2. Age requirement
You must be at least 13 years old to create an account or use onTrak.
If you are aged 13 to 17, we recommend using onTrak with the knowledge and supervision of a parent or guardian, particularly when using camera, recording or Remote Camera features.
3. Your account
You are responsible for:
providing accurate account information;
keeping your account credentials secure;
activity carried out through your account; and
notifying us if you believe your account has been compromised.
You must not access or attempt to access another person's account without permission.
You may delete your onTrak account using the account-deletion functionality provided within the app.
4. Using onTrak
onTrak is designed as a cue-sports practice, training, analysis and entertainment tool.
You may use the service for normal personal cue-sports training and other functionality made available within the app.
You must not:
attempt to bypass security or application-integrity protections;
interfere with the operation of the service;
deliberately overload or abuse our analysis infrastructure;
circumvent usage limits, quotas or other technical restrictions;
submit deliberately excessive, manipulated or automated analysis requests;
reverse engineer or attempt to extract protected server-side systems, models or proprietary technology except where applicable law expressly permits this;
use onTrak to distribute malicious software or unlawful material;
use another person's account without permission; or
use the service for unlawful purposes.
We may restrict, suspend or terminate access where reasonably necessary to protect onTrak, our infrastructure or other users.
5. Shot analysis and scoring
onTrak uses automated technology to analyse cue-sports activity captured by your device.
The system is designed to provide useful training feedback, but automated analysis is not guaranteed to be completely accurate.
Results can be affected by factors including:
camera position;
lighting;
table and cloth conditions;
visibility of balls and pockets;
objects or people obstructing the camera;
recording quality;
device performance; and
unusual shots or playing conditions.
Scores, detections, statistics and other analysis provided by onTrak should therefore be treated as training feedback rather than an infallible measurement or official match decision.
6. Camera and recordings
You are responsible for how and where you use your device's camera.
You should ensure that you have any permission required to record people, premises or other content captured while using onTrak.
You should avoid unnecessarily recording people who are not participating.
Normal drill analysis and Remote Camera may process recordings differently. Details about how recordings and analysis frames are handled are explained in our Privacy Policy.
7. Remote Camera
Remote Camera allows compatible devices to work together to assist with recording and controlling onTrak.
When using Remote Camera, you are responsible for:
positioning devices safely;
ensuring you have permission to record;
maintaining an appropriate network connection; and
ensuring devices do not create a hazard around the playing area.
Remote Camera may temporarily transfer video and audio through cloud services where required to provide the feature.
8. Safe use
Cue sports involve physical movement, cues, balls and equipment.
Always ensure that phones, tripods, mounts, chargers and other equipment are positioned securely and do not create a trip, impact or other safety hazard.
Do not attempt to interact with a phone while doing so would be unsafe.
onTrak is a training aid and does not replace appropriate instruction, supervision or safe playing practices.
9. Your content
You retain ownership of recordings and other content that you create.
You give us permission to process content where necessary to provide the features you request, such as automated shot analysis, Remote Camera, sharing or problem reporting.
This permission is limited to operating, securing, maintaining and improving the relevant onTrak services as described in these Terms and our Privacy Policy.
You must have the necessary rights or permission for content you submit or process through onTrak.
10. onTrak intellectual property
The onTrak application and related materials, including its software, design, branding, graphics, drill content and proprietary technology, are owned by or licensed to ONTRAK SPORTS LTD and are protected by applicable intellectual-property laws.
These Terms give you permission to use onTrak. They do not transfer ownership of our intellectual property to you.
You must not copy, reproduce, distribute or commercially exploit protected onTrak materials except where we have given permission or applicable law allows it.
11. Feedback
During the beta, you may choose to provide suggestions, ideas, bug reports or other feedback.
You agree that we may use this feedback to develop and improve onTrak without an obligation to compensate you.
This does not transfer ownership of unrelated material or content that belongs to you.
12. Availability and changes
We aim to keep onTrak available and reliable, but we do not guarantee uninterrupted availability.
We may need to:
perform maintenance;
change or update features;
impose or adjust reasonable usage limits;
temporarily disable functionality;
correct errors;
update our analysis systems; or
discontinue beta features.
Where practical, we will try to minimise disruption.
13. Beta data
Because onTrak is in beta, you should not rely on it as the sole permanent record of important information.
Although we take reasonable measures to protect and preserve account and training information, beta testing may occasionally require us to correct, migrate or reset data where necessary to fix significant technical problems.
Where reasonably practical, we will avoid unnecessary loss of user data.
14. Charges and subscriptions
The current beta may include features that are provided without charge or under temporary beta access arrangements.
Beta access does not guarantee that those features will remain free after beta testing ends.
We may introduce subscriptions, paid plans or usage limits in future versions.
If paid services are introduced, applicable prices, renewal terms and cancellation information will be presented before you purchase them.
We will not charge you merely because a free beta feature later becomes paid without first requiring the appropriate purchase or agreement.
15. Suspension and termination
You may stop using onTrak at any time and may delete your account using the functionality provided in the app.
We may suspend or terminate access where reasonably necessary because of:
serious or repeated breaches of these Terms;
fraudulent or unlawful activity;
attempts to compromise the service;
deliberate abuse of analysis or cloud infrastructure; or
circumstances where continued access creates a material security or operational risk.
Where appropriate and reasonably possible, we will provide notice.
16. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
onTrak is currently beta software and is provided for cue-sports training and recreational use.
We are not responsible for losses that were not reasonably foreseeable when you agreed to these Terms.
If you use onTrak for business or commercial purposes, additional terms may be required.
Nothing in these Terms affects statutory rights that cannot legally be excluded or restricted.

18. Changes to these Terms
We may update these Terms as the beta develops, particularly where features, payment arrangements, security requirements or applicable laws change.
If a change materially affects your rights or obligations, we will provide appropriate notice where required.
The date at the top indicates when these Terms were last updated.
19. Governing law
These Terms are governed by the laws applicable to England and Wales, subject to any mandatory consumer protections that apply where you live.
If you are a consumer resident elsewhere in the United Kingdom, you may also have rights to bring proceedings in the courts applicable to your place of residence.
