These Terms of Service ("Terms") apply to your use of the onTrak CueSports mobile application and the website at ontrakcuesports.com (together, the "Service").
The Service is operated by ONTRAK SPORTS LTD ("onTrak", "we", "us" or "our"), a company registered in the United Kingdom.
By creating an account, purchasing a subscription, or using onTrak, you agree to these Terms and acknowledge our Privacy Policy at ontrakcuesports.com/privacy.
If you do not agree, you must not use the Service.
1. About onTrak
onTrak CueSports is a pool and cue-sports training application. It uses your phone camera and automated computer-vision processing to help you practise structured drills, receive shot analysis and scoring, and track your progress over time.
2. Eligibility
You must be at least 13 years old to create an account or use onTrak.
If you are aged 13 to 17, we recommend using onTrak with the knowledge and supervision of a parent or guardian, particularly when using camera, recording or Remote Camera features.
You must not use the Service if you are under 13.
3. Your account
You are responsible for:
providing accurate account information;
keeping your sign-in credentials and device secure;
activity carried out through your account; and
notifying us if you believe your account has been compromised.
You must not access or attempt to access another person's account without permission.
You must not share a paid onTrak Pro subscription in a way that is intended to provide paid access to people who have not purchased it.
You may delete your account using the account-deletion functionality provided within the app, subject to section 14 below.
4. Free Introduction and onTrak Pro
onTrak offers a Free experience and a paid subscription called onTrak Pro.
Free Introduction
Free users may access a limited Introduction experience consisting of selected Showcase drills. The Introduction currently includes one Showcase drill from each of these areas of the game: potting, cueing, position, spin and safety.
Each Showcase opportunity may be analysed once without an onTrak Pro subscription. After a technically successful analysis of a Showcase slot, further analysis of that drill requires onTrak Pro.
The Showcase selection may change from time to time. Changing the selected drill for a slot does not reset a slot that has already been used.
The rest of the drill library remains visible, but analysis of those drills requires onTrak Pro.
No payment method is required to use the Free Introduction. The Free experience is not a Google Play or App Store free trial and is not an ongoing analysis allowance.
onTrak Pro
onTrak Pro is a paid auto-renewing subscription purchased through Google Play (Android) or the Apple App Store (iOS). It is offered as a monthly plan and an annual plan.
onTrak Pro provides the paid features described in the app at the time of purchase, which currently include:
access to the full drill library;
continued analysis of your training beyond the Free Introduction; and
Challenge Mode.
Feature availability may change over time. If a material change reduces core paid functionality, we will handle it in accordance with applicable law and the rules of the store through which you subscribed.
5. Subscriptions, billing and app stores
Subscriptions are sold and billed by Google Play (Android) or the Apple App Store (iOS), not directly by ONTRAK SPORTS LTD.
Before you subscribe, the applicable price shown by the relevant app store at the time of purchase, together with the billing frequency, renewal terms and product name shown in that store, are the authoritative purchase terms for that transaction.
Important subscription information:
the subscription price displayed in the relevant app store before you confirm purchase applies to that purchase;
prices may vary by country, currency, tax and store localisation;
subscriptions automatically renew unless you cancel through the relevant app store before the end of the current paid period;
uninstalling onTrak does not cancel your subscription;
you can view, manage or cancel subscriptions in your Google Play or Apple ID / App Store subscription settings, depending on where you purchased;
cancellation normally stops future renewal charges, but access to onTrak Pro normally continues until the end of the paid period you have already paid for, subject to the rules of the relevant app store;
failed or expired payments may result in loss of paid access until payment is restored;
refund eligibility is governed by applicable consumer law and the policies of the relevant app store — ONTRAK SPORTS LTD cannot guarantee refunds outside those rules;
if we change subscription pricing or features, we will comply with applicable law and the requirements of the relevant app store, which may include notice or consent where required.
We do not operate a separate in-app cancellation or refund desk. Subscription management is handled through Google Play for Android purchases and through the App Store / Apple ID for iOS purchases.
Subscription pricing
Subscription prices for onTrak Pro are shown in the relevant app store before you confirm purchase. Prices may vary by region and currency. The price shown in the store at the time of purchase is authoritative and always takes precedence over any prices mentioned on our website or elsewhere.
6. Fair usage
onTrak Pro is intended for normal personal pool-training use. To maintain service availability, manage processing capacity and prevent misuse, Pro accounts are subject to a fair usage allowance of up to 500 analyses per monthly usage period.
A monthly usage period is a one-month window aligned to your current paid subscription period with the relevant app store. For an annual subscription, this means successive one-month windows within the annual paid period. An annual subscription does not provide a larger upfront analysis pool.
We may also apply additional technical protections, including daily, hourly or similar processing limits, to protect the Service.
We may restrict, suspend or terminate access where reasonably necessary because of:
automated or scripted analysis requests;
abnormal or excessive activity beyond normal personal training use;
account sharing intended to circumvent these Terms or paid access;
attempts to circumvent usage, security or integrity controls; or
activity that adversely affects service availability for other users.
7. Acceptable use
You may use onTrak for personal cue-sports training and related features made available in the app.
You must not:
break the law or infringe others' rights;
attempt to bypass security, application-integrity checks or usage limits;
interfere with or overload the Service or our analysis infrastructure;
submit excessive, manipulated, automated or abusive analysis requests;
reverse engineer or extract protected server-side systems except where applicable law expressly permits this;
use the Service to distribute malware or unlawful material;
access another person's account without permission; or
use the Service in a way that creates a safety hazard around a pool table or playing area.
We may restrict, suspend or terminate access where reasonably necessary to protect onTrak, our infrastructure, other users or applicable law.
8. Camera, recordings and Remote Camera
onTrak uses your device camera to record cue-sports activity for training and analysis.
You are responsible for:
using the camera lawfully and safely;
obtaining any permission required to record people, premises or other content captured by your device; and
positioning phones, mounts and chargers so they do not create a trip, impact or other safety hazard.
Normal drill analysis and Remote Camera may process recordings differently, as explained in our Privacy Policy.
Remote Camera allows two signed-in devices to work together so one can film the table while the other controls onTrak. When you use Remote Camera, video and audio may be transferred through cloud services where necessary to provide the feature.
9. Automated analysis and training results
onTrak uses automated computer-vision and related technology to analyse shots and produce scores, overlays, statistics and feedback.
Automated analysis is designed to be useful for training, but it is not guaranteed to be completely accurate. Results can be affected by factors including:
camera positioning or movement;
lighting, shadows and reflections;
table and cloth conditions;
ball visibility and pocket visibility;
obstruction by the player, cue or other objects;
unusual shots or playing conditions;
video quality; and
differences between devices.
Scores, detections, statistics, replays and other outputs should be treated as training feedback, not guaranteed measurements, official match decisions or proof of performance.
onTrak does not guarantee that you will improve at pool or any cue-sport.
10. Your content
You retain ownership of recordings and other content you create.
You give us permission to process content where necessary to provide features you request, such as automated analysis, Remote Camera, sharing or problem reporting, as described in these Terms and our Privacy Policy.
You must have the necessary rights or permission for content you submit or process through onTrak.
11. onTrak intellectual property
The onTrak application, website content, software, design, branding, drill content and related materials are owned by or licensed to ONTRAK SPORTS LTD and protected by applicable intellectual-property laws.
These Terms give you a personal, non-exclusive licence to use the Service. They do not transfer ownership of our intellectual property to you.
12. Service availability and changes
We aim to keep onTrak available and reliable, but we do not guarantee uninterrupted availability.
We may need to perform maintenance, update features, impose reasonable usage limits, correct errors, change analysis systems or modify Free or paid functionality.
Where practical, we will try to minimise disruption.
13. Suspension and termination
You may stop using onTrak at any time and may delete your account in the app.
We may suspend or terminate access where reasonably necessary because of serious or repeated breaches of these Terms, fraudulent or unlawful activity, attempts to compromise the Service, deliberate abuse of analysis or cloud infrastructure, or circumstances where continued access creates a material security or operational risk.
Where appropriate and reasonably possible, we will provide notice.
14. Account deletion
You can permanently delete your onTrak account from within the app (Profile → Account & subscription → Delete account).
Deletion removes the account and associated cloud data handled by that process, as described in our Privacy Policy.
Deleting your account does not automatically cancel an active Google Play or App Store subscription. You must cancel subscriptions separately through Google Play or the App Store / Apple ID, depending on where you purchased.
15. Limitation of liability and consumer rights
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
onTrak is a training and recreational tool. To the fullest extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when you agreed to these Terms.
If you use onTrak for business or commercial purposes, additional terms may be required.
If you are a consumer in the United Kingdom, you have statutory rights that cannot be excluded. These Terms do not affect those rights.
16. Privacy
Our processing of personal information is explained in the onTrak CueSports Privacy Policy at ontrakcuesports.com/privacy.

17. Changes to these Terms
We may update these Terms when the Service changes, when payment arrangements change, when legal or regulatory requirements change, or for other reasonable operational reasons.
If a change materially affects your rights or obligations, we will provide appropriate notice where required by law or the rules of the relevant app store.
The date at the top of these Terms indicates when they were last updated.
Continued use of onTrak after changes take effect constitutes acceptance of the updated Terms where permitted by law.
18. Governing law
These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply where you live.
If you are a consumer resident elsewhere in the United Kingdom, you may also have rights to bring proceedings in the courts applicable to your place of residence.
